Terms of Service

Last updated: October 22, 2026

These Terms of Service (the “Terms”) make up a binding agreement between you and Budget Proxies (the “Company”, “we”, “us” or “our”) covering how you access and use the proxy services we offer at budgetproxies.com. Do take the time to read them and keep a copy for your records. They go hand in hand with our Privacy Policy, Acceptable Use Policy, Proxy Usage Policy and Refund & Replacement Policy, each of which forms part of these Terms by reference.

Company details

© 2026 Budget Proxies — budgetproxies.com. All rights reserved. These Terms form a binding agreement between you and Budget Proxies. Wherever these Terms say “Company”, “we”, “us” or “our”, that means Budget Proxies.

1. Acceptance of these terms

Setting up an account, placing an order, signing in to the dashboard or the API, or making any other use of the Service, you confirm two things: that you have read and understood these Terms along with the policies they pull in by reference, and that you agree to be bound by them. Should any part of these Terms not work for you, please do not use the Service. Where you accept these Terms for a company or another organisation, you confirm you hold the authority to bind that entity, and from that point “you” means that entity.

2. Definitions

Throughout these Terms, unless the context plainly demands something else:

  • “Service” means the proxy access, dashboard, API and related services the Company provides.
  • “Account” means the account you sign up for in order to use the Service.
  • “Order” means a purchase of a data allowance for a particular proxy type.
  • “Proxies” means the datacenter, residential, mobile (4G/5G) and residential premium IP addresses supplied to you under an Order.
  • “Target” means any website, platform, server or service that you reach by routing through the Proxies.
  • “Content” means any data, request or material that you pass through the Service.

3. Eligibility & account registration

You must be at least 18 years old to use the Service, and legally capable of entering a binding contract. At sign-up you agree to supply information that is accurate, current and complete, and to keep it that way afterwards. Anything that takes place under your Account rests on your shoulders. An Account may be refused, suspended or closed by us where the details given are inaccurate, where we cannot confirm eligibility, or where compliance with applicable law leaves us no choice.

4. The service

Access runs to datacenter, residential, mobile (4G/5G) and residential premium proxy IPs, all of them speaking HTTP, HTTPS and SOCKS5, with authentication by username and password or by IP whitelist. Once payment clears, the proxies appear in your dashboard. Lawful, legitimate use is the only use the Service is meant for. Features, IP pools and locations may be added, altered, withdrawn or exchanged by us at any point, and IPs that fall away through upstream conditions may be replaced.

5. Pricing & billing

Prices are quoted and charged in US dollars (USD, $), without exception. Pay-as-you-go is the model, metered per gigabyte (GB) of data you move, so what you use is all you ever pay for: datacenter from $2.49/GB, residential from $3.98/GB, mobile (4G/5G) from $4.98/GB and residential premium from $6.99/GB. Whatever price shows at checkout is the price you pay for that Order, with nothing added later. Our prices may shift from time to time, though no change will ever reach back to an Order you have already paid for.

6. Payment, currency & taxes

Third-party payment providers handle the money: card payments go through Stripe, alongside whichever cryptocurrency options we support. Your full card details never touch our servers. You authorise us, and those providers, to charge the payment method you hand over for the sums owed. A charge is one-off unless you deliberately switch auto-renew on for an Order, and where you do, you authorise the matching renewal charges to run until you switch it off again. Taxes, duties and levies sit outside our prices unless we state otherwise; any of those that apply to your purchase are down to you, as are any fees charged by your bank or payment provider.

7. Plan validity

Each Order comes with a fixed 30-day validity counting from the day you buy. The data allowance on an Order needs to be used within that window. Any data you do not use will not carry over to a new Order and expires once the 30-day period ends, used or not. Expiry happens automatically and applies no matter how much balance is left.

8. Refunds & replacements

Proxies are dead on arrival when they refuse to authenticate, refuse to connect, or fail to hand over the kind of access described. Should that be what you received, get in touch within 24 hours of delivery. We will first try to swap out the affected Proxies at no extra cost, and where we cannot supply working Proxies that match your Order, we will refund the affected portion. After the 24-hour window, requests are looked at case by case and we may offer a replacement rather than a refund. Refunds are not available for misuse, for data you have already used, or where an Order has been ended for breaching these Terms. The full details sit in our Refund & Replacement Policy.

9. Acceptable use

Lawful, legitimate purposes are the only ones you may put the Service to. You agree to keep within all applicable laws, and to respect the terms of service, the robots.txt directives and the rate limits of every Target you connect to. Your use also falls under our Acceptable Use Policy, which lays out exactly what is and is not allowed. You alone stay responsible for everything you do through the Service.

10. Prohibited activities

Beyond what our Acceptable Use Policy already says, the Service must never be used by you, directly or indirectly, to:

  • run any activity that breaks the law where you are, where we are, or where any Target happens to sit;
  • reach systems, networks or accounts without authorisation, hacking among it, along with credential brute-forcing and probing for vulnerabilities nobody has given you permission to test;
  • commit fraud of any description at all, with payment-card fraud, carding and identity theft included in that;
  • push out spam or unsolicited bulk messages, or operate phishing campaigns;
  • circulate malware, ransomware, spyware or any other malicious code;
  • trample the intellectual-property rights of others, software piracy included, along with copying or redistributing protected works without authorisation;
  • attack infrastructure, including denial-of-service activity, traffic flooding and resource exhaustion;
  • obtain, hold or pass on child sexual abuse material, or any content whatever that exploits or endangers minors;
  • harass, stalk, threaten or doxx anyone; or
  • breach the terms of service, the acceptable-use rules or the rate limits of any Target you reach.

Break this clause and your access may be suspended or terminated at once, with no refund, and where the law demands it, the matter may go to the relevant authorities.

11. Proxy usage policy

Technical and fair-use rules for running the Proxies, which cover session handling, concurrency and sensible request rates, are set out in full in our Proxy Usage Policy. You agree to stay within those rules so the Service stays stable and dependable for every customer. We do not claim the Proxies will stop any Target from restricting, throttling or suspending your access, and using each Target within its own rules is down to you.

12. Customer obligations & protecting your credentials

Your password, your API key and any IP-whitelist configuration are yours to keep secure, and whatever happens through your Account or API key falls to you as well, authorised by you or not. Sharing, selling or sublicensing your access is out unless we have expressly allowed it. Tell us at once at [email protected] if you spot any unauthorised use of, or any security breach affecting, your Account.

13. Service availability

We aim for 99.9% uptime and run across 55+ countries, but that is a target rather than a cast-iron guarantee. The Service may be down or slowed by maintenance, upstream provider issues, network conditions, or events outside our reasonable control. We may run scheduled or emergency maintenance and will make reasonable efforts to keep disruption to a minimum. Uptime and the performance of individual IPs are offered on a best-effort basis.

14. Suspension & termination

Access to the Service may be suspended or ended by us, whether in whole or in part, with notice or without it, depending on how serious the problem is. That can happen where we reasonably believe you have breached these Terms or any policy they bring in, where the law or a valid legal request requires it, or where protecting the Service, our other customers or third parties calls for it. Stopping your own use is your choice, at any time you please. Once things end, your right to use the Service halts immediately, while clauses meant by their nature to survive, among them prohibited activities, disclaimers, limitation of liability, indemnification and governing law, carry on applying. Ending an Order because of a breach gives you no right to a refund.

15. Disclaimers & warranties

To the fullest extent the law permits, you take the Service “as is” and “as available”, carrying no warranty of any kind, express, implied or statutory, and that includes the implied warranties of merchantability, of fitness for a particular purpose, of title and of non-infringement. No promise is made by us that the Service runs without interruption, that it comes free of errors, that it is secure, that any single IP will be there when you want it, or that the Service will match your precise needs or produce a particular result against any Target. Where a liability cannot lawfully be excluded or limited, nothing in these Terms excludes or limits it.

16. Limitation of liability

So far as the law allows, the Company will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or business, arising from or connected to the Service or these Terms, even if we were warned such loss was possible. So far as the law allows, our total combined liability arising from or connected to the Service is capped at the total amount you paid us for the Service in the 30 days right before the event that gave rise to the claim. Nothing in this clause limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be limited.

17. Indemnification

You agree to indemnify the Company along with its officers, employees, agents and suppliers, to defend them, and to hold them harmless from any claim, liability, damage, loss or expense (reasonable legal fees counted in) arising out of or connected with how you use the Service, with your Content, with a breach by you of these Terms or of any policy they bring in, or with any law you break or any third-party right you infringe, the rights of a Target included.

18. Intellectual property

The Service, website, dashboard, software, documentation, trademarks, logos and every piece of related content belong to the Company or to its licensors, and intellectual-property laws protect them. We grant you a licence that is limited, non-exclusive, non-transferable and revocable, to use the Service for its intended purpose and in line with these Terms. Copying, modifying, reverse-engineering, reselling or building derivative works from the Service is not permitted, save where the law expressly allows it. Content of your own remains yours.

19. Privacy

Our treatment of personal data, and the limited operational metadata we process, is set out in our Privacy Policy. We do not log the destinations or URLs you reach through the Proxies; bandwidth is only ever measured in total for billing. By using the Service you accept the data practices described in the Privacy Policy.

20. Third-party services

Third parties keep the Service running, payment providers and upstream network suppliers among them, and the Service may link to or work alongside outside websites and services. Content, policies and practices of any third party are not something we answer for, and where you use a third-party service, that party’s own terms govern it. Every Target you connect to stands independent of us, so whatever relationship exists with that Target is a matter between you and it.

21. Changes to these terms

These Terms may be revised by us from time to time as the Service changes and the law around it changes with it. Significant amendments will be flagged by email to active customers, and the “Last updated” date above will show them. A change takes effect once posted, and using the Service beyond that date means you accept the revised Terms. Where a change does not suit you, please stop using the Service.

22. Governing law & jurisdiction

These Terms, and the way they are interpreted, are governed by the laws of the jurisdiction where the Company is established, as is any dispute or claim tied to them or to their subject matter, with conflict-of-laws principles set aside. Except as the dispute-resolution clause below provides, the courts of that jurisdiction hold exclusive jurisdiction over any such dispute.

23. Dispute resolution

Something gone wrong? Come to us first, since most issues get sorted quickly and informally that way. Both parties agree to make a good-faith attempt at settling any dispute through direct talks before formal proceedings begin. Nothing in this clause prevents either party from seeking urgent injunctive or equitable relief, and nothing in it touches any non-waivable rights you may hold as a consumer under the law that applies to you.

24. Force majeure

Where a failure or delay in meeting our obligations comes from events outside our reasonable control, we carry no liability for it. Such events take in acts of God, natural disasters, war, terrorism, civil unrest, government action, labour disputes, power or internet outages, the failure of upstream providers, and denial-of-service or other cyber-attacks. Our obligations stand paused for as long as the event runs, and we will return to performing them as soon as doing so is reasonably practicable.

25. Severability & entire agreement

Should any provision of these Terms be found invalid or unenforceable, that provision gets cut back or struck out only so far as is necessary, and everything else stays in full force and effect. Failure on our part to enforce a right or a provision is not a waiver of it. Together with the policies brought in by reference, these Terms form the entire agreement between you and the Company about the Service, and they supersede any earlier agreements on that subject. Assignment or transfer of these Terms by you requires our consent; we, for our part, may assign them as part of a merger, an acquisition or a sale of assets.

26. Contact

Legal notices, or any question you have about these Terms, should come to us at [email protected] or through our contact page.
